What is notarization translation?
Here, notarization translation refers to translation of notarization items involving foreign affairs or foreign nationals. As Notarial Certificate needs to be taken to the destination country, it must be translated into the language of that country. Generally, in order to be valid, a Notarial Certificate involving foreign affairs or foreign nationals requires certification from Chinese embassies or certification from Chinese embassies plus embassies of the destination country.
What is notarization involving foreign affairs or foreign nationals?
Notarization involving foreign affairs or foreign nationals refers to a case of notarization in which a notary public office certifies the authenticity and appropriateness of legal acts, documents, and facts (needed by the applicant for handling of matters abroad) in accordance with domestic or foreign applications as well as the applicable legal procedures. Issues under notarization vary depending on their nature and content. Issues involving foreign affairs or foreign nationals generally include: (1) Proof of the identity of a citizen or legal person, such as birth, age, experience, education, post, title, and length of employment. (2) Proof of marital relations or kinship, such as marriage, divorce, adoption, claim, guardianship, etc. (3) Proof of the subsistence, death, disappearance, or domicile of a person. (4) Proof of inheritance and/or will. (5) Proof of the endowment, division or transfer of property and power of attorney. (6) Proof of the authenticity and legality of contract. In handling such cases of notarization, notary public offices should abide by the basic principles and procedures of notarization in China. They must also adhere to the principle of national sovereignty, flexible handling, and special principles such as attention to the validity period of documents. Concerning procedures, in addition to compliance with the relevant legal procedures for notarization, legal provisions on certification procedures should also be followed.
When Chinese citizens apply for visas of the destination country, the required materials often include proof of relations between the applicant and his/her relatives and friends in that country as well as legally valid and notarized documents concerning legal acts or facts, in order to obtain visas and deal with matters involving foreign affairs or foreign nationals. Such notarization is legally effective in foreign countries.
